It has been revealed that the number of violations of the Food Sanitation Act by dining franchise operators such as chicken, tteokbokki, mala tang, and tanghulu has exceeded 2,500 cases over the past five years. However, it has been pointed out that administrative penalties for these violations are mostly fines and corrective orders, which are relatively light punishments.
According to data on “Violations of the Food Sanitation Act by Dining Franchises” submitted by the Ministry of Food and Drug Safety to Seo Mi-hwa, a member of the National Assembly’s Health and Welfare Committee, the top 10 dining franchises for chicken, hamburgers, tteokbokki, pizza, mala tang, and tanghulu recorded a total of 2,583 violations of the Food Sanitation Act from 2019 to June 2024.
By year, there were 444 cases in 2019, 408 cases in 2020, 419 cases in 2021, 524 cases in 2022, 560 cases in 2023, and 228 cases in June 2024, showing an increasing trend every year since 2021.
By type of food, chicken had the most violations with 1,155 cases (44.7%), followed by hamburgers with 548 cases (21.2%), tteokbokki with 358 cases (13.9%), pizza with 284 cases (11%), mala tang with 219 cases (8.5%), and tanghulu with 19 cases (0.7%).
By type of violation, “standards and specifications violations” due to foreign substances in food were the most common with 1,008 cases (39%), followed by 641 cases (24.8%) of uncompleted hygiene education, 294 cases (11.4%) of violations of sanitary handling standards, 214 cases (8.3%) of uncompleted health check-ups, and 175 cases (6.8%) of violations of business compliance matters.
Administrative penalties for violations included 1,149 cases (44.5%) of fines, 1,104 cases (42.7%) of corrective orders, 155 cases (6%) of business suspensions, 103 cases (4%) of additional fines, 71 cases (2.7%) of facility renovation orders, and 1 case (0%) of business closure. It has been pointed out that fines and corrective orders, which account for 2,253 cases (87.2%), are relatively light punishments.
By brand, the order of violations was BBQ (202 cases), Mom’s Touch (199 cases), BHC (187 cases), Lotteria (141 cases), Goobne Chicken (140 cases), Kyochon Chicken (132 cases), McDonald’s (106 cases), Cho Ga Chip Yangnyeom Chicken (101 cases), Dongdaemun Yeopgi Tteokbokki (100 cases), Nene Chicken (93 cases), Shinjeon Tteokbokki (92 cases), Hosigi Dumari Chicken (86 cases), Mexicana (73 cases), Jikoba Chicken (72 cases), Pelicana (69 cases), Tanghulu Kungfu Mala Tang (65 cases), Pizza Nara Chicken Gongju (51 cases), Cheongnyeon Dabang (49 cases), Pizza School (40 cases), and Dookki (36 cases).
Seo Mi-hwa emphasized, “As dining franchise operators are increasing like mushrooms after the rain, the government needs to thoroughly manage and supervise to prevent violations of the Food Sanitation Act,” and added, “The Ministry of Food and Drug Safety and local governments should strengthen crackdowns and penalties, and franchise headquarters should take responsibility for hygiene guidance.”
